Mr. Newton joined the firm as an associate in February 2008. His practice is focused in the areas of business and commercial litigation, real estate litigation, probate and trust litigation, fiduciary litigation, employment litigation, general civil litigation, family law litigation and divorce, marital property law, and creditor rights law. Mr. Newton has successfully tried cases to verdict on a number of occasions. He also has extensive experience drafting and negotiating marital and premarital agreements for his clients and effecting the judicial modification of trusts to better suit the needs of his clients.

Experience
- Trial counsel for family in dispute related to appropriate disposal of decedent’s mortal remains. Obtained a favorable verdict from judge whereby the judge agreed with the family’s request to honor the decedent’s wishes.
- Successfully obtained summary judgment relief for trust and estate beneficiaries against an executor/trustee for theft of funds and other breach of fiduciary duties.
- Obtained summary judgment relief for numerous commercial creditors seeking to collect on amounts owed by debtors.
- Assisted with two-week jury trial involving the interpretation and enforcement of a decedent’s will and the administration of the decedent’s multi-million dollar estate.
- Successfully defended towing company at trial in lawsuit for alleged violations of the Texas Towing and Booting Act.
- Represented both employers and employees in disputes related to non-competition and non-solicitation agreements.
- Obtained favorable settlements while representing executors and trustees in cases involving breach of fiduciary duty claims asserted by estate and trust beneficiaries.
- Represented multiple commercial landlords and obtained favorable settlements for amounts owed by defaulting tenants, including representation in eviction appeals at the County Court level.
- Represented numerous property owners and contractors in construction matters and mechanic’s lien disputes, including first-chair trial experience representing subcontractors seeking to recover construction funds and foreclose on mechanic’s lien.
- Successfully prosecuted defendants in violation of the Texas Deceptive Trade Practices Act for misrepresentations made in connection with consumer transactions.
- Prepared, filed and obtained judgments granting the requested relief in multiple trust modification proceedings.
- Negotiated and prepared dozens of premarital agreements and marital agreements for clients.
