Alternative dispute resolution refers to alternative methods to a traditional courthouse trial to resolve a dispute. The firm regularly participates in alternative dispute resolution including the two most popular methods of arbitration and mediation.
Arbitration
The process of arbitration involves the parties to a dispute submitting their differences to a neutral individual or panel of individuals who will typically reach a binding decision to resolve the dispute. The firm has experience in initiating and defending participants in binding arbitration proceedings in a wide variety of cases including employment matters, business disputes and construction disputes.
Mediation
Mediation is a process whereby the parties to a dispute utilize the assistance of a neutral third party to try to resolve their disputes by agreement. Parties may voluntarily agree to attend mediation or may be required to engage in mediation by contract or order of a court. The firm works closely with its clients to help select a mediator, prepare for the mediation and to meaningfully engage in the mediation process.
